Measures for the Administration of green Manufacturing System Construction in Hunan Province

Act 1 总则

    Article 2 The green manufacturing system construction referred to in these measures refers to the creation of green factories, green parks, green supply chain management demonstration enterprises as the main content, and the units that have obtained national and provincial green factories, green parks, and green supply chain management demonstration enterprises are collectively referred to as green manufacturing system demonstration units。

    Article 3 The green manufacturing system construction management referred to in these Measures refers to the activities in which the competent authorities guide enterprises or parks to establish green manufacturing systems in accordance with relevant standards and document requirements, and conduct compliance evaluation and supervision and management on the basis of evaluation results after the establishment。

    Article 4 These measures are applicable to the evaluation and management of green manufacturing system construction in the administrative area of Hunan Province。

    Article 5 Enterprises and parks are encouraged to actively carry out the creation and evaluation of green manufacturing systems, and the creation work follows the principle of voluntalism, and the evaluation work follows the principle of voluntalism, fairness, justice and openness。

    Article 6 The Provincial Department of Industry and Information Technology is responsible for the recommendation and management of the national green manufacturing system, the evaluation and management of the provincial green manufacturing system demonstration, and the municipal (prefecture), county (city, district) industrial and information technology departments are responsible for the cultivation, establishment, recommendation and daily management of the green manufacturing system construction in their respective jurisdictions。

Act 2 Create condition

    Article 7 Basic conditions for creating green factory and green supply chain management demonstration enterprises:

    (1) It has the status of an independent legal person in the province, is established according to law, and shall comply with relevant laws, regulations, policies and standards in the construction and production process。

    (2) The enterprise has a good economic and technological foundation and economic benefits, the relevant performance indicators are better than the average level of the same industry, and has obvious competitive advantages in the same industry in the province。

    (3) The enterprise has a high level of quality, occupational health, environmental protection, production safety and energy and resource management, sound management systems, continuous operation, and constantly improve the environmental management system, occupational health and safety management system, quality management system, and energy management system。

    (4) Enterprises should attach great importance to industrial energy saving, water saving and cleaner production work, and enterprises with conditions should actively participate in the establishment of industrial carbon emission reduction benchmarking enterprises and water-saving enterprises, consciously carry out energy-saving diagnosis, and strengthen the application of diagnostic results。

    (5) The following circumstances shall not occur in the past three years: the relevant provisions on mandatory disclosure of environmental information are not strictly implemented，Large or above environmental protection, safety (including network security, data security), product quality, occupational injury and other accidents，Be blacklisted for dishonesty，Serious problems were found in the relevant inspections of The State Council and relevant ministries，Be punished in industrial energy conservation supervision or be required to rectify within a time limit and fail to complete the rectification as required。

    (6) Meet the relevant standards and evaluation requirements of green factory and green supply chain management demonstration enterprises。

    Article VIII Basic conditions for creating a green park:

    (1) The Park shall be an economic and technological development zone, high-tech industrial development Zone, bonded zone, new district, free trade zone or provincial industrial development zone approved by the national or provincial government (hereinafter referred to as the Park).。

    (2) No major or above pollution accidents or ecological damage events have occurred in the park in the past three years, and the energy conservation and emission reduction targets issued by the national or local government have been fulfilled, and the carbon emission intensity has continued to decline。

    (3) The environmental quality of the park meets the national or local environmental quality standards for environmental functional zones, the pollutants discharged by enterprises in the zone meet the standards, and the total emission of various key pollutants does not exceed the national or local total control requirements。 

    (4) 100% of key enterprises in the park have implemented mandatory cleaner production audit, and the proportion of voluntary cleaner production enterprises has increased year by year。

    (5) Enterprises in the park shall not use backward production technologies, processes and equipment listed in the elimination catalogue by the State, and shall not produce products listed in the elimination catalogue by the State。

    (6) The Park has established a special agency to perform the duties of green development, and is equipped with more than 2 full-time staff。

    (7) Meet the relevant standards and document requirements of the Green Park。

Act 3 Create and evaluate work procedures

    The ninth article Requirements and working procedures for establishing provincial green factories, green parks, and green supply chain management demonstration enterprises:

    (1) According to the relevant requirements of green manufacturing system evaluation issued by the Ministry of Industry and Information Technology, the creation unit shall prepare the "Hunan Green Manufacturing System creation work Plan" (see Annex 1 for the outline of preparation), and submit an application for creation to the municipal and state Industry and information Technology Bureau or the provincial pilot county (city) industry and information department。

    (2) The municipal, state or provincial directly administered pilot county (city) industry and information technology department shall, after reviewing the creation plan of the enterprise or park, recommend it to the provincial Department of Industry and Information Technology。The Provincial Department of Industry and Information Technology reviews the enterprise and park creation plans reported by the city, state or provincial pilot county (city), selects the enterprises and parks that are representative and demonstrative of the industry, determines the provincial green manufacturing system creation unit, and releases the annual provincial green manufacturing system creation plan。

    (3) Enterprises or parks included in the annual provincial green manufacturing system creation plan，Check the relevant standards and documentation requirements of green manufacturing systems，Conscientiously carry out the creation work，After the implementation of the creation scheme is completed，Self-evaluation against corresponding criteria，And prepare the Self-Evaluation Report;Self-evaluation meets the requirements of green manufacturing system evaluation standards，Entrust a third-party evaluation agency to carry out on-site evaluation according to the corresponding evaluation standards and procedures，And prepare the Third Party Evaluation Report。

    (4) Enterprises and parks that have passed the evaluation of third-party institutions shall submit the "self-evaluation Report" and the "third-party evaluation Report" to the industry and information technology department of the city, state or provincial directly administered pilot county (city), and report to the provincial Industry and Information Technology Department after the review of the industry and information department of the city, state or provincial directly administered pilot county (city)。

    (5) The Provincial Department of Industry and Information Technology organized experts to review the reported "self-evaluation Report" and "third-party evaluation Report", and organized experts to carry out on-site verification of qualified enterprises and parks。The list of enterprises and parks that meet the conditions of provincial green factories, green parks, and green supply chain management demonstration enterprises after audit will be publicized on the website of the Provincial Industry and Information Technology Department for 7 working days, and will be published by the provincial Industry and Information Technology Department after there is no objection。

    Article ten The establishment of national-level green factories, green parks and green supply chain management demonstration enterprises shall be carried out in accordance with the relevant documents and requirements of the Ministry of Industry and Information Technology。Units declaring national green factory, green park, green supply chain management demonstration enterprises should, in principle, first be evaluated as provincial green factory, green park, green supply chain management demonstration enterprises。

Act Four Evaluation agency management

    Article 11 The third party evaluation agency shall meet the following conditions:

    (1) Enterprises and institutions with independent legal personality, trade associations, etc., have the experience and ability to carry out relevant evaluations。

    (2) It has a fixed office space and office conditions for carrying out evaluation work, and has a sound financial management system。

    (3) There are no less than 10 full-time staff with intermediate professional titles or above engaged in green evaluation, including no less than 5 senior professional titles in energy, environment, ecology, low-carbon, life cycle evaluation and other related professions。

    (4) Establish a strict institutional management system, evaluation procedures, evaluation personnel management system, expert review system, etc。

    (5) The staff shall abide by national laws and regulations and evaluation procedures, and be familiar with green manufacturing related policies and standards。

    (6) The evaluation agency and all full-time personnel engaged in the evaluation of the green manufacturing system need to sign labor (or employment) contracts and pay social insurance in accordance with the law。

    (7) No illegal behavior or bad credit record in the past three years。

    (8) Have the ability to carry out green factory, green park, green supply chain and other fields of evaluation, in the past five years to lead or participate in green manufacturing related review, demonstration, evaluation or provincial or above scientific research projects, or national, industry and group green standards, or green manufacturing related policy development。

    Article 12 Third-party evaluation agencies should strengthen self-discipline and take the initiative to promote green manufacturing on the national public service platform (website: http://www).gmpsp.org.cn/) on the self-declaration and disclosure of relevant certification materials, to facilitate enterprises and parks to choose the best, accept social supervision。Relevant supporting materials should include:

    (1) Basic information of the organization。

    (2) A copy of the business license of the enterprise legal person or a copy of the certificate of the legal person of the institution。

    (3) Photocopies of technical title certificates and legal documents certifying labor relations of evaluators。

    (4) Third-party service certification materials for green development, clean production, energy-saving diagnosis, comprehensive utilization of resources and other related businesses in the past three years。

    (5) Relevant management system and internal control procedure documents。

    (6) Other relevant certification materials。

    Article 13 The third party evaluation agency shall carry out the third party evaluation of the green manufacturing system in accordance with the relevant national laws and regulations, policy standards and these Measures, form the evaluation results and issue the evaluation report。The third-party evaluation agency shall be responsible for the evaluation report and accept supervision。

    Article 14 The third party evaluation agency shall submit the evaluation report at the same time    Submit the Self-Declaration of the evaluation ability of the third-party Evaluation Agency (see Annex 2) and the certification materials that the agency has made a self-declaration and been approved by the National green Manufacturing public service platform。

    Article 15 After the completion of the annual green manufacturing system creation work, the provincial Department of Industry and Information Technology evaluated the quality of the evaluation work of third-party evaluation agencies。Evaluation methods and contents are as follows:

    (1) Quality assessment is mainly to understand the daily work, check the third-party evaluation report and evaluation project files, and can be carried out in the form of listening to reports, consulting information, holding discussions, individual understanding, etc., if necessary, ask the head of the organization or go to the evaluated unit to investigate and verify the relevant situation。Each evaluated institution shall actively cooperate, truthfully provide information and relevant information, and shall not resort to fraud。

    (2) The quality assessment includes: the comprehensive strength assessment of the institution, the quality assessment of the third-party evaluation report and the quality assessment of the evaluation process (see Annex 3 for the evaluation indicators).。

    第十六条 The competent departments of industry and information technology at all levels shall strengthen the qualification examination of third-party evaluation agencies，Third party evaluation agencies that practice fraud and have poor quality assessment，Cancel its qualification to carry out green manufacturing system demonstration evaluation in Hunan Province;For third-party organizations that do not have the basic conditions，The evaluation report and results are not accepted。

Chapter Five Supervision and administration

    Article 17 Green manufacturing system demonstration units implement dynamic management。Provincial green manufacturing system demonstration units to a three-year cycle, after the expiration of the green factory, green park, green supply chain management demonstration enterprises should be reviewed as required。Within a triennium，Green factory due to investment, mergers and acquisitions or other reasons, the actual production and business scope, production address or organizational boundaries have been significantly changed compared with the green manufacturing list，Due to management and other reasons, the boundary of the green park is significantly changed when it is included in the green manufacturing system demonstration unit，Green supply chain management demonstration enterprises due to investment, mergers and acquisitions or other reasons, the actual management has changed significantly compared with the green manufacturing list，Should apply for re-evaluation in time after the change。

    Article 18 The green manufacturing system demonstration unit undergoing review shall report the production and operation situation and the change of the main green manufacturing system indicators in the previous evaluation cycle，And fill in the green manufacturing system demonstration unit review form (see Annex 4)，After the examination by the industry and information department of the county (city) directly administered by the city or province, it shall be submitted to the provincial Department of Industry and Information Technology for review，If necessary, the provincial Department of Industry and Information Technology will organize on-site spot checks，Dynamically adjust the model list according to the actual situation。

    Article 19 Green factories, green parks and green supply chain management demonstration enterprises undergoing reevaluation shall prepare reevaluation reports in accordance with the relevant standards and requirements of green manufacturing system self-evaluation，Form re-evaluation material，The re-evaluation materials shall be submitted to the provincial Department of Industry and Information Technology after preliminary examination by the municipal, state or provincial pilot county (city)，The review of the reevaluation materials is organized by the provincial Department of Industry and Information Technology，And timely release of re-evaluation results。

    Article 20 National green manufacturing system demonstration units shall report the progress of green manufacturing work once a year as required, fill in the "Green Manufacturing Dynamic Management Form" (see Annex 5), and pass the Industrial energy conservation and green development management platform (website: http://green) within the specified time.miit.gov.(cn) Submit to the Department of Energy Conservation and Comprehensive Utilization of the Ministry of Industry and Information Technology, and copy to the provincial Department of Industry and Information Technology。

    Article 21 The provincial Department of Industry and Information Technology will award and commend the newly created demonstration units of the green manufacturing system and give support in accordance with the relevant documents。For green factories and green supply chain management demonstration enterprises at the provincial level and above, it is recommended to apply for "specialized and special new" small giant enterprises, to support the creation of carbon emission reduction benchmarking enterprises, and to apply for special funds projects in strong manufacturing provinces。For green parks approved at the provincial level and above, appropriate extra points will be given in the evaluation of the planning and positioning of the "Five good" parks。

    Article 22 Industrial and information technology authorities at all levels should strengthen the daily supervision of green manufacturing system demonstration units, urge enterprises and parks to submit the development of green manufacturing work and relevant information as required, timely review or re-evaluation, and timely fill in the "Green Manufacturing Dynamic Management Form".。Enterprises and parks exist one of the following circumstances, the competent departments of industry and information technology at all levels should immediately report the relevant situation to the provincial industry and information Technology Department, the provincial industry and information technology Department after verifying the relevant situation, immediately adjust the demonstration list。

    (A) the occurrence of large or above environmental protection, safety, product quality, occupational injuries and other accidents。

    (2) Serious problems are found in the relevant supervision of The State Council and relevant ministries and commissions。

    (C) in the industrial energy conservation supervision is punished or required to rectify within a time limit and does not complete the rectification as required。

    (4) being included in the blacklist of dishonesty。

    Article 23 Green manufacturing system demonstration unit name change, reorganization and other major adjustments, should be in 30 working days after the relevant procedures through the city, state or provincial directly administered pilot county (city) industry and information technology department review and report to the provincial Department of industry and information technology to apply for adjustment。

Act 6 附则

    Article 24 These Measures shall come into force as of the date of promulgation and be valid for five years。
